AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Aligned Branding LLC (“Company,” “we,” “us,” or “our”), concerning your access to and use of the www.agajanowska.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). By accessing the Site, you confirm that you have read, understood, and agree to be bound by these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you to any changes by updating the “Last updated” date above, and you waive any right to receive specific notice of each change. It is your responsibility to periodically review these Terms of Use to stay informed of updates. Your continued use of the Site represents acceptance of the revised Terms.

The information on the Site is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be contrary to law or regulation or subject us to any registration requirement within such jurisdiction. Those who access the Site from other locations do so on their own initiative and are responsible for compliance with local laws.

The Site is intended for users who are at least 18 years old. Persons under 18 are not permitted to use or register for the Site.

21. Use a buying/purchasing agent to make purchases on the Site.
    
    
22. Collect usernames and/or emails for sending unsolicited email or create accounts by automated means or under false pretenses.
    
    
23. Use the Site to compete with us or for any revenue-generating endeavor or commercial enterprise not authorized by us.
    
    
24. Unauthorized use and/or duplication of Site material without express written permission from the author and/or owner is strictly prohibited. Excerpts and links may be used, provided full and clear credit is given to Agnieszka Janowska and Aligned Branding LLC with an appropriate and specific direction to the original content at agajanowska.com.
    
    

USER GENERATED CONTRIBUTIONS

The Site does not currently offer users the ability to post content publicly. If, however, you submit or transmit to us any content, including text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information (“Contributions”), such Contributions may be handled in accordance with our Privacy Policy. You represent and warrant that you own or have the necessary rights to such Contributions; they are not false or misleading; do not violate third-party rights, laws, or regulations; and do not contain unlawful, obscene, defamatory, harassing, or otherwise objectionable material.

Any use of the Site in violation of the foregoing may result in termination or suspension of your rights to use the Site.

CONTRIBUTION LICENSE

You agree that we may access, store, process, and use any information and personal data you provide in accordance with our Privacy Policy and your choices (including settings). By submitting suggestions or feedback about the Site, you agree we may use and share such feedback for any purpose without compensation to you. We do not claim ownership over your Contributions; you retain all rights therein. You are solely responsible for your Contributions.

SUBMISSIONS

Any questions, comments, suggestions, ideas, feedback, or other information regarding the Site (“Submissions”) provided by you are non-confidential and become our sole property. We own exclusive rights, including intellectual property rights, and may use and disseminate Submissions for any lawful purpose without acknowledgment or compensation. You waive all moral rights to such Submissions and warrant they are original or you have rights to submit them.

THIRD-PARTY WEBSITES AND CONTENT

The Site may contain links to third-party websites (“Third-Party Websites”) and third-party content (“Third-Party Content”). We do not investigate, monitor, or check Third-Party Websites or Third-Party Content for accuracy or completeness and are not responsible for any Third-Party Websites accessed through the Site or any Third-Party Content available through or installed from the Site. Inclusion of, linking to, or permitting the use or installation of Third-Party Websites or Third-Party Content does not imply approval or endorsement. Access and use are at your own risk and subject to the terms and policies of such third parties. We are not responsible for purchases made through Third-Party Websites.

SITE MANAGEMENT

We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms; (2) take legal action against anyone violating laws or these Terms; (3) refuse, restrict access to, limit availability of, or disable any of your Contributions; (4) remove or disable files and content that are excessive in size or burdensome; and (5) otherwise manage the Site to protect our rights and facilitate proper functioning.

PRIVACY POLICY

By using the Site, you agree to be bound by our Privacy Policy, which is incorporated into these Terms. The Site is hosted in the United States. If you access the Site from another region with different data laws, you consent to transferring and processing your data in the United States.

TERM AND TERMINATION

These Terms remain in full force while you use the Site. We may, in our sole discretion and without notice or liability, deny access to and use of the Site (including blocking certain IP addresses) to any person for any reason or no reason, including for breach of any representation, warranty, or covenant contained in these Terms or of any applicable law. We may terminate your use or delete any content or information you posted at any time, without warning. If we terminate or suspend your account, you are prohibited from registering and creating a new account under your name or a third party’s name. We reserve the right to pursue appropriate legal action.

You agree to submit to the personal jurisdiction and venue of the state and federal courts located in Cook County, Illinois for any dispute not subject to arbitration (if applicable) or otherwise not barred by these Terms.

USER DATA

We will maintain certain data that you transmit to the Site for the purpose of managing performance of the Site, as well as data relating to your use of the Site. Although we perform routine backups, you are solely responsible for all data you transmit or that relates to any activity you undertake using the Site. You agree we shall have no liability for any loss or corruption of such data.

We may assign any or all of our rights and obligations at any time. We are not responsible for any loss or delay caused by circumstances beyond our reasonable control. If any provision is unlawful, void, or unenforceable, that provision is deemed severable and does not affect remaining provisions. No joint venture, partnership, employment, or agency relationship is created between you and us as a result of these Terms or use of the Site. You waive any defenses based on the electronic form of these Terms and the lack of signing by the parties to execute these Terms.
